EU Consumer Rights & Right of Withdrawal

This page sets out the rights of consumers resident in the European Union (and, where equivalent, the EEA and the United Kingdom) when buying from Elektrisches Racing at a distance (online). These rights are granted by the EU Consumer Rights Directive (2011/83/EU, as amended by the Omnibus Directive 2019/2161) and related law. For EU/EEA consumers, the terms on this page apply and take precedence over any conflicting terms in our general Refund Policy (which continues to apply to customers outside the EU/EEA).

2. Your 14-day right of withdrawal

As an EU/EEA consumer you have the right to withdraw from your purchase within 14 days without giving any reason.

  • The withdrawal period expires 14 days from the day on which you (or a third party you nominate, other than the carrier) take physical possession of the goods. For an order of multiple goods delivered separately, the period runs from receipt of the last item.
  • To exercise the right, tell us your decision to withdraw by a clear statement — by email to support@elektrischesracing.com, or using the model withdrawal form in section 6. To meet the deadline, it is enough to send your communication before the 14-day period expires.

3. Effects of withdrawal — refunds

  • We will reimburse all payments received from you, including the standard cost of delivery (except any supplementary cost arising from your choice of a delivery type other than the cheapest standard delivery we offer).
  • We will make the reimbursement without undue delay, and no later than 14 days from the day we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is earliest.
  • We will reimburse using the same means of payment you used for the initial transaction, at no extra fee.
  • No restocking fee and no cancellation fee apply to EU/EEA consumers exercising the right of withdrawal. You may, however, be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

4. Returning the goods

  • You must send back the goods without undue delay and no later than 14 days from the day you communicate your withdrawal.
  • You bear the direct cost of returning the goods.

5. Exceptions to the right of withdrawal

The right of withdrawal does not apply to certain contracts, including: goods made to the consumer’s specifications or clearly personalised; sealed goods unsealed after delivery that are not suitable for return for health/hygiene reasons; and goods that, after delivery, are inseparably mixed with other items. Standard catalogue parts are returnable under section 2.

7. Legal guarantee of conformity (2 years)

Separately from the right of withdrawal, EU/EEA consumers benefit from a legal guarantee of conformity of at least 2 years under Directive (EU) 2019/771. If goods are faulty, not as described, or otherwise not in conformity with the contract, you are entitled to have them repaired or replaced free of charge or, where appropriate, to a price reduction or refund. This legal guarantee is provided by us at no cost and is in addition to, and not affected by, any commercial/manufacturer warranty.

Note: for certain branded items (e.g. Baja Designs, Warp 9, Sur-Ron OEM, GUTS Racing, KO/EBMX) a separate manufacturer’s commercial warranty may also be available. Your statutory rights against us as the seller are not limited by that warranty.

8. Prices and taxes

For EU/EEA consumers, prices shown at checkout for your destination are intended to be the total price payable. Any import VAT and duties applicable to your destination are indicated before you complete your order where we collect them; where they are not collected by us, this is stated at checkout and you may be charged on import.

9. Complaints and dispute resolution

If you have a complaint, please contact us first at support@elektrischesracing.com and we will try to resolve it. EU consumers may also access their national consumer dispute resolution (ADR) bodies. (Note: the European Commission’s online ODR platform was discontinued in 2025; please use your national ADR entity or contact us directly.)

What's my order status?

To lookup the status of your order, click here! If you have an elektrischesracing.com account, you can log in and view order status and tracking on the Order History page. MOST orders placed Monday-Friday before 5pm will usually ship the same business day. For All orders placed after the cut off time or placed Saturday-Sunday will ship the following business day (Monday-Friday). Please note: Orders placed during special promotions (Black Friday/Cyber Monday) and holidays may take additional processing time due to increased order volume. How do I cancel my order?

Depending on the status of your order, we may not be able to cancel it. In order to best assist with your request, we recommend reaching out to us via email or live chat for immediate assistance. If we are unable to cancel your order, we can always walk you through our easy returns process.

How do I return a product?

How long will it take to receive my refund?

I forgot to add an item to my order; can I make a change before it ships?

Once your order has been completed, the order goes almost immediately to processing and then it’s sent to the warehouse to ship. To get your order to you as fast as possible, no changes can be made at this stage. Please place a new order on the website for the additional items.

Can I change the color/size of what I just ordered?

Can I make a change to my billing or shipping address before my package ships?

You may change your shipping address after you place an order by contacting customer service below. Typically, you can only do this the same day an order was placed because items are shipping as fast as possible. If an item has already been processed for shipping, you may not be able to change the address. All address corrections are subject to review and can be declined following a security screening.
